Privacy

Our collection, use and disclosure of your personal information is regulated by the National Privacy Principles under the Privacy Act 1988, as amended from time to time and also by the relevant State legislation. When you visit our website(s), information is automatically logged by our web content management system (CMS) and our Internet Service Provider (ISP). Details of your visit and logs information include your IP address, date and time of your visit, page and document interactions, browser type and versions as well as where you came from i.e. the referring site or media. This information is used for analysis purposes to determine website usage and interactions. We do not use this to identify users or their browsing activities unless required by law, where a law enforcement agency may exercise a warrant to inspect our service provider's logs. 

By signing up or joining a mailing list, your details are added to that specific mailing list and used for the stated purpose of that list only. Further, the City of Kalamunda records your contact details (in accordance with government record keeping standards) when emails are sent to us. This information will only be used for the purpose for which you have provided it.

Online Services Terms & Conditions

The City of Kalamunda enables customers to process certain transactions online, through the City of Kalamunda website. These Online Services are subject to the terms and conditions stated below.

Use of Online Services

You may use information provided to you through City of Kalamunda Online Services, solely for your personal and/or internal business purposes, provided that you do not remove any proprietary rights notices, do not modify the information or make it available to any third parties.

In using Online Services you declare that you are over 18 and have legal capacity to contract in Australia. If you are using a credit card to process a transaction, you declare that the credit card is issued in your name and you will pay to the issuer all charges incurred using Online Services. If you are using a City of Kalamunda account, you declare that you are authorised to use the login ID and password allocated to such account.

Privacy Statement

You authorise the City of Kalamunda to collect information about you and about transactions processed by you through City of Kalamunda Online Services. This information will be treated in accordance with the City of Kalamunda Disclaimer. The City of Kalamunda may disclose information about you (including your identity) to a third party, if the City of Kalamunda is requested to do so in the course of a criminal or other legal investigation, or if the City of Kalamunda determines that disclosure is necessary in connection with any complaint regarding your use of the site.

Collecting your information

Using Online Services, you agree to provide any relevant information, documents and attachments, through electronic means, in the format and to the standards described for each transaction. You also agree and understand that the information collected will be retained in electronic form.

Providing information to you

Using Online Services, you agree to receive information through electronic means. Where information is requested by another person, the requesting party is deemed to be the recipient's agent and is presumed to have obtained the consent of the recipient to receive the information in electronic format.

Accounts

Certain Online Services offered by the City of Kalamunda may require a login ID and password for verification of your identity. You agree that all information provided to City of Kalamunda by you in relation to your account shall be current, complete and accurate.

Password security

In the event that the City of Kalamunda, at any future stage, elects to make use of a login process, we recommend you select a password that does not relate to any readily accessible data such as your name, birth date, address, telephone number, driver's licence, licence plate or passport. It is also recommended that the combination of letters and numbers is not obvious and does not include sequential or repeated numbers or letters. You are entirely responsible for maintaining the security of your login ID and password, and for all activity which occurs on or through your account, whether authorised or unauthorised, including use by current and former employees if you are a corporate entity. You should change your password immediately if you believe that your login ID and password have been used without authorisation. The City of Kalamunda shall not have any liability for your failure to comply with these obligations.

Website security

Online Services are provided through a secure website [using SSL (secure socket layer) encryption]. However, you acknowledge and agree that Internet transmissions are never entirely secure or private, and that any message or information you send to or through the website (including credit card information) may be read or intercepted by others, even where a website is stated as being secure. The City of Kalamunda shall have no liability for the interception or ‘hacking' of data through the website by unauthorised third parties.

Accuracy of transaction information

Upon completing a transaction using Online Services, you will be presented with a confirmation screen verifying the transaction details you wish to process. It is your responsibility to verify that all transaction, credit card/account information and other details are correct. You should print the transaction confirmation for future reference and for your files. The City of Kalamunda shall have no liability for transactions which are incorrect as a result of inaccurate data entry in the course of providing Online Services or for loss of data or information caused by factors outside of the City of Kalamunda's control.

Limitation of liability

Except as expressly prohibited by law, in no event will the City of Kalamunda be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even where City of Kalamunda has been advised of the possibility of such damages occurring. If, notwithstanding the foregoing, the City of Kalamunda is found to be liable to you for any damage or loss which arises as a result of your use of the website, City of Kalamunda's liability shall not exceed the dollar amount of the transaction which formed the basis of the damage or $100.00, whichever is less? Some jurisdictions do not permit the exclusion of implied warranties, and if you are in one of those jurisdictions these exclusions may not apply to you

Right to suspend, alter or cancel service

The City of Kalamunda shall be entitled at any time without prior notice or any liability to you, to cancel or suspend any or all Online Services and/or to substitute alternative services, which may or may not be interactive or transactional in nature.

Specific service terms and conditions

You acknowledge that access to our website and any Online Services made available by the City of Kalamunda may be subject to periodic review of these Terms and Conditions and that you accept being bound by any changes posted on the website resulting from such review. Access and use of the website and any online service shall be deemed to constitute acceptance of any such additional terms and conditions applicable to such service from time to time.
